It's arse covering, they're saying they have made a judgement on the events, not the person. Making sure it's harder to be seen as defamatory and, I guess, therefore challengeable in a real court where a higher bar for evidence might be required.

God, no! He was worse than Hitler. Just look at the offences he was found guilty of

 - five counts of one man's word against another, with no evidence whatsoever

 - one count of using a Spanish word that both the expert witnesses brought in by the FA said was neither racist nor offensive and even Evra acknowledged wasn't racist (although he initially thought it was)

 - one count where neither player suggested anything racist or offensive was said and there's (obviously) no evidence of anything racist or offensive being said.

 

Clearly, that's a hate crime. The stuff the English bloke said was "banter".
