How could the league justify reducing or suspending Evertons point deduction if first of all they where warned and ignored it because they didn't give a shit and then secondly they have done nothing to rectify the situation to the point they have fallen foul to the rules again. Well it's not for the league to justify it. In exactly the same way, it wasn't the leagues job to justify the first decision. It's an independent panel. They hear the evidence from the PL, they hear the evidence from Everton, they hear the bullshit from both sets of lawyers and then they make a decision. It's what makes the whole #corrupt thing a massive joke. All the PL did was enforce their rules after Everton breached them. A breach they themselves acknowledged and admitted, even if they did come to a different number. The independent panel upheld the PL position based on the evidence. The only piece for debate is the actual penalty. The premier league had no punishment tarrif in place. So the panel used reference from similar situations outside the PL. I imagine this is why it's taking so long for the appeal.
