I think McDonald would have had some kind of defence in that he honestly believed she would have consented had she been sober maybe based on things she may have said/done earlier in the evening. Obviously Evans could have had no such belief because he's not been with her. Just a guess like.

Thing is though the girl said she woke up in the hotel and had no idea how she got there. They both shagged her at the hotel. Coupled with the judge's CCTV comments about her appearing clearly out of it while still out on the town, it just makes no sense. There's a very big piece of the puzzle not being reported here.

Yeah but the point stands. How long had McDonald been with her? Had she earlier been with him sober and she'd given him a promise, therefore he'd have a reasonable defence I would have thought but clearly not the other bozo. Like I say just a guess.

Irrelevant from a legal standpoint. The issue is whether she was able to consent at the time that the sex occured.

I think for the McDonald its easier to aver that he reasonable believed that the girl consented. They were drinking, she returned to his hotel room arm in arm with Mcdonald.

 

Whereas Evans behaviour of conning the receptionist into giving him the key and then joining McDonald in the hotel room and then raping her. Its not as easy to argue reasonable belief of consent.

True, but it's whether the jury understood that, and whether they gave McDonald the benefit of the doubt because he'd been with her whereas Evans just turned up for a ride afterwards.

Mcdonald carried her to his hotel room. She was passed out according to the hotel receptionist.
