They haven't been actively "uploading" anything. It's a passive online backup "service".

 

Like most cloud services no doubt Apple technically own the images (hence why photos some of the celebs say they deleted - Mary Elizabeth Winstead for example - are still present on the behind the scenes database), so they probably have more recourse in terms of legal action than any of the celebs...

 

They should be made to clarify exactly what "delete" means in Apple's world though.
