Nurse Kelvin Fore, 33, from Middlesbrough, also jailed for six months for wilfully neglecting patients.

 

Holly Laura Draper, 24, of Mangotsfield, pleaded guilty to two charges of abuse and was jailed for 12 months.

 

Daniel Brake, 27, of Downend, pleaded guilty to two charges of abuse and was given a six month jail sentence suspended for two years and ordered to carry out 200 hours of unpaid work.

 

Charlotte Justine Cotterell, 22, from Yate, pleaded guilty to one charge of abuse and was given a four-month jail term suspended for two years. Cotterell was ordered to do 150 hours of unpaid work and complete 12 months supervision.

 

Michael Ezenagu, 29, from Shepherds Bush, west London, admitted two counts of abuse and was given a six month jail sentence suspended for two years and ordered to carry out 200 hours of unpaid work.

 

Neil Ferguson, 28, of Emerson Green, admitted one count of abuse and was given a six month jail term was suspended for two years and ordered to carry out 200 hours of unpaid work.

 

Jason Gardiner, 43, of Hartcliffe, who admitted two charges of abuse, was given a four month jail term was suspended for two years and ordered to carry out 200 hours of unpaid work.

This bit really grinds my gears. It sounds like they're almost making an excuse.

 

Poorly paid, inappropriately-trained staff working long shifts were left to devise their own methods of coping with people with serious learning difficulties, involving water torture, slapping, pinning down and forced feeding of medication.

 

What. The. Fuck? Surely anyone with a single shred of humanity or concience would realise that the above is not appropriate behavour towards *anyone* whatsoever. Well, Jim Davidson excepted.

Can I just ask mate, what are the Police failings in this case? You seem to be pretty upset with them. I heard the sentencing on the radio today and thought they were paltry in comparison to what should have been dished out.

 

My younger brother has learning difficulties and conceivably could one day end up in a place such as this, so it's not as if I'm here to defend the Police.

The police failed to investigate/act upon several complaints made to them and refused to use the evidence I gave them meaning others walked away without facing charges.

 

Both the police and CPS are at fault for charging under the Mental Health Act, they all should have been charged under the Mental Capacity Act. Being found guilty of abuse when charged under the MCA comes with 5 years minimum tariff.

Former residents of Winterbourne View assaulted in new homes, Panorama to claim

 

 

A follow-up to the shocking Panorama report on abuse of people with learning disabilities at Winterbourne View will allege that former residents have faced further assaults in other homes.

 

The second Panorama report will be aired on Monday 29 October on BBC1 from 8.30-9pm.

 

With Winterbourne View now closed, and 11 of its former staff having been convicted of assault, the programme will tell the stories of some of the patients who suffered, using undercover footage never seen before. It also examines allegations that a number of former residents have faced further assaults or unnecessary restraints in other homes.

 

Andrea Pope-Smith, joint chair of the Association of Directors of Adult Social Services learning disability policy network, said: "It won't be easy, it won't be pretty [viewing]. It will ask how much progress has been made in the last 18 months. The answer is not enough, that step change hasn't taken place yet."

 

Speaking at the National Children and Adult Services Conference in Eastbourne, Pope-Smith also revealed that a document will shortly be sent to all adult directors of social care.

 

This will set out key questions that must be asked of all provision for people with learning disabilities. These include: knowing what placements have been made in local areas and why, including settings that local authorities don't use; whether service users all have independent advocates; knowing what restraint methods are being used; and are there any patterns around safeguarding referrals.

The whole situation is sick, the punishments dished out are not likely to deter others from doing the same thing. If you employ people who have no desire to do the job other than to earn a wage then you are always going to get these things happening, especially in today's job market where everything is done on the cheap so those at the top can carry on stuffing their bank accounts. They need to change the whole employment process within this section.

If anyone in this country with an LD stood any chance of high quality, specialist support following the Panorama programme it would have been these guys.

 

It just highlights how fucked up the system is and the government policy of wanting no central involvement is a joke.

It was and I thought that I remembered your opinion of him from previous posts, hence my cautious reaction. I missed the name of the other studio guest but he was raising the issue that the government to date have not spoken about placing any compulsion on local authorities to provide appropriate local services

Burstow has done fuck all except come out and sound good to the cameras. I'd argue all he's done is patronise people with an LD and their families in fact.

 

The government have not and will not, they believe in no central involvement. It is a disgrace.

 

The bird had to give evidence in court to get Birmingham council to provide the support they are already legally required to. Asking them nicely to do something extra is like me asking nicely for a pay rise.

 

I'll have my bosses say a few nice words and get fuck all.

The fact that he came across so well and unreserved in his condemnation of Castlebeck backs your view that he feels that he has nothing to defend and that the current proposals are adequate...just dogma over what is really required to ensure the best possible standards of care

 

And, dare I ask, where is the CQC in all of this?

Just to clarify that.

 

There have been 19 safeguarding alerts in relation to former WV patients. More than one alert can be in relation to the same person.

Having just watched the Panorama programme I hardly know where to start, from the footage from the first programme to what has happened since to the 2 'patients' featured.

What also struck me from the footage of WV was the bleakness of the decoration and the apparent lack of any kind of activity.

I don't work in daytime adult social care but from my knowledge of the Scottish system I don't recognise the kind of lengthy assessments described although am aware of people being placed far away from their families because of the lack of local resources.

The authors of the SCR clearly picked up on the shortcomings of WV but given the current system it would be surprising not to see similar abuse being perpetrated elsewhere given the lack of regulation and obligation placed on purchasers services and providers alike
