EXCLUSIVE Burnley, Leeds and Leicester are set to WITHDRAW plan to sue Everton, as aggrieved trio seek negotiated settlement instead following Toffees' 10-point deduction for breaking spending rules

 

The aggrieved trio first served notice of their intention to sue Everton last May along with Nottingham Forest and Southampton in a letter to the Premier League, with the independent commission chaired by David Phillips KC ruling that they had a potential case. 

 

The commission’s imposition of a 10-point penalty on Everton a fortnight ago initially increased the clubs’ resolve to claim as they would all have avoided relegation from the Premier League had the sanction been applied during the seasons in which Everton were found to have breached spending rules, but following further discussions it appears they may opt to negotiate instead.

 

As previously reported by Mail Sport there are major doubts over Everton’s ability to pay any fine imposed by the commission, as the club are relying on £20million-a-month loans from prospective buyers 777Partners to fund their day-to-day operations, which would leave them facing administration and a further nine-point penalty. 

Everton were docked ten points by a committee but have appealed their punishment. Burnley are set to withdraw their planned claim for compensation. Leicester, who were relegated last season, are also set to withdraw.

 

Leeds also joined Leicester in dropping to the Championship.

 

Despite feeling aggrieved by the Premier League’s handling of the matter Burnley, Leeds are Leicester are also conscious of not wanting to be responsible for forcing Everton into administration, a consideration which has influenced their thinking.

 

If Everton agree to negotiate the case would go to arbitration rather than being heard by the Premier League’s independent commission that imposed the 10-point penalty.

 

In addition to seeking to negotiate with Everton the clubs could also bring a claim against the Premier League for alleged failures in their disciplinary process, on the grounds that delaying Everton’s hearing by several months led to them being relegated. 

 

The Premier League did seek to have the case heard last season after charging Everton in March however, but were denied by the commission.

 

In a separate development Everton have submitted their appeal against the 10-point deduction with the hearing expected to be heard next month. The Premier League have committed to concluding the case within the next three months.

This is how the cabal that is the PL operate. They are mafiosos who decide who lives and dies as a football club. Everton have enough 'friends' to squirm out of this.

They're not saying they don't want compo though are they? They're saying they just don't want to play it out in court and agree an out of court settlement. It feels like most compo claims to me. Look to be willing to go to court to establish seriousness and confidence in the case before then control costs and risk by doing a deal without court that everyone can work with. The downside is it probably means Everton will pay, but pay on the drip. On the plus side, it doesn't help their finances going forward. 

 

As for the PL not acting more quickly, I'm not sure what they could do? They charged Everton within days of them submitting their accounts. They requested the independent commission to hear it early and they said it wasn't possible (another illustration of the PL not controlling the independence of the process). The only thing the PL could have done differently was by insisting accounts are submitted earlier, but that's not the rules and rules all 3 clubs agreed to before the season started. 

 

I reckon it's still the least of Everton's problems. In the next few weeks we'll find out if their takeover is approved. If it's not, they're as good as bankrupt anyway. If it is, they're then in the hands.of just about the least desirable owners possible, with debt at over 500m and rising by the day. They'll either go pop when the takeover fails or in a few months when 777 go to shit.

It sounds a bit like the West Ham/Sheffield United settlement.  That was £15m in 2009; I'd imagine each of the three clubs would want much more than that now.  It wouldn't be enough to end them, but it would presumably fuck their Profit and Sustainability for a few more years.

I think anything extra if it was imposed today and had to be paid now could fuck them. But obviously that's not going to happen. So between now and when any fine is imposed or agreed, we get the outcome of their proposed takeover, which is really the main thing on their horizon and more likely to fuck them than the points deduction or compo claim. As you say, the worst any fine can do is make them less competitive down the line.

If Trump gets in, he stops all support to Ukraine and lifts sanctions on all Putin’s mates. The UK will only be too happy to go along to get the money laundering through London off and going again. Usmanov can then ride in to the rescue.

They’d get the Prem to agree to treat it as an exceptional item to be excluded from the FFP tests. Which may be the main point behind all this publicity campaign against the Prem - to put them on the back foot re 777 and any compo they have to pay.
