A lose/lose situation for the FA.

 

If Suarez is found guilty there will be pressure for criminal charges, if the criminal test is more demanding than the FA's and the case is thrown out, the FA are masively compromised.

 

If Suarez is found innocent, Evra presses criminal charges, and the case is proven, the FA are massively compromised.

 

None of us know the detail, yet, but the suspicion is that this has been allowed to get way out of hand.

Which is why he should never have been charged. If Evra alleges a criminal offence then he should make a complaint to the police. I'm not defending racist taunts, if there's sufficient evidence then Suarez should be charged by the police.

 

We now have a situation where the FA are attempting to pass judgement and interpret the meaning of a conversation between two individuals. What are the FA going to define as offensive behaviour going forward, repeated use of the 'F' word? Evra may well have thrown every insult under the sun at Suarez but because it may not have been racist then that's ok?

 

The Terry case is interesting, because once the police investigation is complete there's no reason for the FA not to launch their own investigation given that this has now come into the public domain and they must be clearly aware of Terry's apparent behaviour? As I recall with Rooney's recent outburst at the camera, it wasn't reported by a player or match official but the FA acted once it was in the public domain. Surely Terry's case is just the same?

How about Suarez is found guilty, he then sues the FA in the highest courts in the land for deformation of character without any evidence.

If Evra had pressed charges with this bollocks he'd have been laughed at, 23 cameras and 22 other men on the pitch didn't hear a thing, how'd you think that would go in front of a jury chief?

There is no way the Crown Prosecution Service will prosecute if the case has already been disproved by an FA Panel who work on a lesser burden of proof than is needed in the criminal courts.
