The chief prosecutor of the International Criminal Court has applied for arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Hamas's leader in Gaza for war crimes.

Karim Khan said there were reasonable grounds to believe that both men bore criminal responsibility for war crimes and crimes against humanity from at least 7 October 2023.

The ICC, based in The Hague, has been investigating Israel's actions in the occupied territories for the past three years - and more recently the actions of Hamas as well.

Mr Netanyahu recently called the prospect of senior Israel figures joining the ICC's wanted list "an outrage of historic proportions".

The ICC chief prosecutor has announced that he will be seeking permission to issue arrest warrants for the Hamas top brass and Benjamin Netanyahu and Yoav Gallant (Minister of Defence) on suspicion of committing a series of war crimes, including extermination, murder, rape, torture, starvation of civilians as a method of warfare, intentionally directing attacks against a civilian population. 
 

Give them all some Saddam Hussein type justice.

It would be great if they could all be thrown into prison, preferably sharing the same cell so they can settle their differences in person and away from innocent civilians. 
 

Now let’s see how the US and UK will make sure that permission will never be given.

Be interesting to see how the ICC move this forward. Both the individuals' states are not signatories and the ICC knows there is no chance of support from the US.

 

As an organization that's reason for existence is to deal w genocide it is remarkable that virtually every country that could be in that conversation on both sides - Israel, US, Russia, China, Saudi Arabia, Ukraine, Yemen, Sudan - are all non participating (most for decades) or never signed on for varied reasons.

The ICC does not have its own police force or enforcement mechanism, but the warrants would seriously limit the travel options of the indictees. The 124 state members of the ICC would be under obligation to arrest them, and even non-members would come under pressure to carry out an arrest.

 

That appears to be the limit to it's enforcement capabilities.

 

 

 

 

 

The problem with the indictments, for me, is that there are hundreds of people out there who should also be facing charges.

 

For example, Paul Kagame (with whom the UK is cooperating on it's refugees-to-Rwanda scheme) attended Arsenal's most recent CL match in London, despite being indirectly responsible for the deaths of millions in the DRC over the past 30 years.

It's a bit of a conundrum  - the ICC.

 

Remember South Africa had leveled similar re: Israel.

 

That is the same South Africa that had been working for years towards leaving the ICC with regards to not wanting to arrest al-Bashir years ago when he had a warrant issued.

 

They then decided against leaving when a similar warrant was issued for Putin prior to a state sponsored visit there last year. Another that they chose not to enforce.
