Oscar Pistorius

Was due to be released today, on what would have been her 32nd birthday. For some reason his release has been suspended.

Haven't the Prosecution just applied to re-try him for murder. I'm sure I read that somewhere earlier this week.

Hope he gets the highest possible sentence and is slung inside before New year, cunt of a man.

The minimum sentence for murder is 15 years but judges can apply some discretion.

Pistorius can challenge the ruling in the constitutional court but only if his lawyers can argue that his constitutional rights have been violated. Legal expert Mannie Witz told the BBC that there do not appear to be any grounds for such an appeal.

The only place to make an appeal would be at the Constitutional Court. It would only hear the matter if:

  • The defence can show that Pistorius' rights have been infringed in the way justice was carried out
  • Or if the defence can show that hearing the case would be in the public's interest and of national importance.

Mr Witz says as it stands, there are no grounds for either.

South African law does not make provision for someone to be placed under house arrest for more than five years - so Oscar Pistorius will definitely go back to prison.

The minimum sentence for murder is 15 years.

But the defence can argue that there are compelling circumstances that should be considered, for example his disability - and the fact that the double amputee has already served a year in prison.

Experts think anywhere between 10 and 12 years would be a fair sentence for murder in his case.

Dreadful individual as I noticed at the Olympics a few years ago, as is that other chap with springy legs who climbs mountains. These types have no regard for anyone but themselves in their pursuit of achievement in the face of adversity as such. Cunt he is, so take him back down for many a year.
