If the defender is stationary and the attacker runs into him, it's an offensive charge and a foul against the attacker. If the defender moves into the path of the attacker, it's a foul against the defender. Straightforward, fair and logical.

That would make it a non-contact sport IMO

Then you'd have refs trying to judge what line players were moving on, how much movement from a defender makes him "non-stationary", you'd get fouls given for attackers running into defenders on purpose if they were moving slightly, knowing that by the rules it would be given a foul. 

Not sure it would really be straightforward.

 

Also I believe a lot of basketball people want offensive charges removed from basketball as they encourage stupid defending and lead to injuries.
