Oh dear, that'll upset the 14 PL clubs and their fans!

 

A furious judge has ordered all financial and legal sanctions brought against the 12 European Super League plotters, including the English clubs, to be cancelled with immediate effect.

In a stinging court order seen by Sportsmail, Judge Manuel Ruiz de Lara, who presides over a commercial court in Madrid, has taken aim at UEFA, the Premier League and Italian Serie A, claiming they attempted to 'annihilate' his attempts to defend the European Super League clubs in April.

In that first ruling on April 20, the judge declared UEFA must not threaten clubs wanting to participate in the Super League or do anything that might deter them from joining.

However, that has not stopped UEFA and the Premier League reaching 'agreements' with nine of the errant clubs, which will result in them accepting financial sanctions and future penalties.

And it has also done nothing to prevent UEFA from opening a disciplinary investigation into the three remaining rebel clubs, Barcelona, Real Madrid and Juventus, which have refused to recant.

This has clearly antagonised Judge Ruiz de Lara, who insists all of these actions are in breach of his initial judgement and contrary to European competition law.

'These actions… constitute a flagrant violation of the order… of 20 April 2021,' he said in his latest ruling on Thursday.

'These are not isolated acts (...) but a succession of acts and statements forming part of a strategy devised by the defendants with the aim of provoking the ineffectiveness of a court decision.

 

'The opening of disciplinary proceedings against Real Madrid, Juventus and Barcelona constitutes a clear breach of the interim measures granted by the Order of 20 April 2021.'

In his ruling, Judge Ruiz de Lara, has instructed UEFA that the three unrepentant clubs must be allowed to compete in the Champions League next season.

He has also told UEFA to abandon all disciplinary action against the three rebels, or risk 'serious financial and criminal sanctions'. Under Spanish law anyone ignoring a court order could face up to one year in prison.

In addition, the nine clubs that abandoned the ill-fated project within two days of its launch, which includes the six English clubs and Inter Milan, AC Milan and Atletico Madrid, should be freed from the 'agreement' they made with UEFA in the aftermath of the scheme.

This includes an obligation to pay £13 million to a solidarity fund, forgo five percent of income from European competition next year and pay a £86 million penalty if they ever try to join a Super League again,

The judge then directed his fury at the Premier League, insisting that UEFA has to tell the English top flight that all actions against the Big Six – Manchester United, Liverpool, Manchester United, Tottenham, Arsenal and Chelsea – must be 'annulled'.

The Premier League is due receive a 'goodwill gesture' from the breakaway clubs of around £22m – with any further attempts to leave subject to a 30-point deduction.

Similarly, the Italian Football Federation is also warned to avoid any sanctions against Super League clubs.

The judge is scathing of the 'agreements' UEFA and the Premier League made with the repentant clubs, which resulted in financial sanctions.

'The concealed sanctions imposed on certain founding ESL clubs, simply under the euphemism of calling them an agreement, are a clear breach of our interim measures order,' he said.

Expert competition lawyers had warned that UEFA was flying close to the wind when it continued to pursue action against the Super League plotters and rebels.

Specialist sports lawyer, Mark Orth, of MEOLaw, told Sportsmail: 'The Spanish court is saying to UEFA, you can’t get away with this. You cannot ignore our judgement.

‘In many cases like this it is typical for sports authorities to reach a settlement with the organisations involved and the substantive issue are not considered in court, as a result.

‘But in this case, UEFA has only managed to get agreement with some of the clubs and the court is insisting that its decisions are respected.

'It could be very important, because this could result in the court making a major decision on whether clubs have the right, under competition law, to form a Super League or not.'

UEFA president, Aleksander Ceferin and executive committee member, Javier Tebas, who is also president of La Liga, made outspoken remarks about the prospect of disciplinary action, which have also not gone unnoticed by the judge.

The European football governing body was finally forced to cease its disciplinary case against the three rebel clubs in early June, when the judge's first court order reached UEFA headquarters in Nyon, Switzerland. However, the body announced a suspension, not a termination of the process.

The latest development has offered encouragement to the rebels.

Juventus chairman, Andrea Agnelli, declared yesterday: ‘'We are not scared of threats and we are confident that our legal action will lead to satisfactory results, but the real success would be if we return to a dialogue. We're absolutely certain we will play Champions League in the 2021-2022 season,'

Real Madrid, Barcelona and Juventus, are defended by Jean-Louis Dupont from the law firm, Roca Junyent, Martin Hissel from Elegis and Clifford Chance in Madrid.

Me too. I don't want to see yet another breakaway league but I would like a ruling body that isn't as bent as a five bob note and was interested in leveling the playing field rather than lining it's own pockets. But this is symptomatic of the world at large unfortunately.

UEFA will be ordered to compensate the three European Super League rebels with tens of millions of pounds if it attempts to impose a Champions League ban in punishment for pursuing the breakaway competition.

The European governing body's ability to sanction Real Madrid, Barcelona and Juventus has become entangled in legal restrictions.

UEFA is furious that the three clubs have refused to recant their commitment to the new league, but it's ability to take action against them is now increasingly limited by a Spanish court.

The Madrid institution is determined to uphold the rights of clubs to form a breakaway league, citing competition law in two legal orders from Judge Manuel Ruiz de Lara.

First, the court forced UEFA to suspend its disciplinary investigation into Barca, Juve and Madrid and in a second order reported by Sportsmail on Friday, Judge Ruiz de Lara has told the body it must 'refrain from excluding the founding clubs of the ESL from competitions organised by UEFA' or face 'serious financial and criminal sanctions'.

Sportsmail now understands the judge has indicated the clubs will be entitled to 20 per cent of their lost revenues from the Champions League in compensation each month, if UEFA ignore his demands and they are excluded from the competition.

No wonder Juventus chairman, Andrea Agnelli, appeared confident last week that he and his colleagues at Madrid and Barcelona are well placed.

''We are not scared of threats and we are confident that our legal action will lead to satisfactory results, but the real success would be if we return to a dialogue,' he said. 'We're absolutely certain we will play Champions League in the 2021-2022 season.'

Typically, a well-established club, such as the rebels, would expect to make well over £100 million if they reached the final stage of the lucrative competition..

 

The three teams were among the 12 'founding clubs' in the Super League project, which burst into life on April 18.

However, while the other nine sides, which includes England's Big Six, quickly abandoned the scheme within 48 hours, the three heavyweights have stuck it out and refused to back down.

Infuriated, UEFA launched a disciplinary investigation into the clubs, which could result in a two-year ban from the Champions League.

But last month the governing body announced it was suspending the action after the Spanish court's first order, demanding that UEFA did nothing to intimidate the Super League clubs, issued on April 20, finally landed in Nyon, Switzerland.

The Judge's second order accuses UEFA of not complying with the first one and sets out a list of demands to demonstrate it is now compliant.

In the order, the judge insists that sanctions against the nine repentant clubs, which includes Manchester United, Liverpool, Manchester City, Chelsea, Tottenham and Arsenal, agreed with them by UEFA and the Premier League should be cancelled.

It's a bit of a mixed blessing for the average fan. On one hand it's great that UEFA are shown up for the cunts they are but it's also depressing that any big club can just go to court and quash any penalty imposed on them and continue to keep the same clubs at the top of the game getting richer at the expense of everybody else.

It looks like the Spanish clubs made a complaint under Spanish competition law against UEFA, possibly for abuse of a dominant position.

I still don't think this was ever anything more than a play to grab more power. The 3 rebel clubs have as much chance of being kicked out as I do of getting a blowie from Rita Ora.  If we weren't playing on the night the shit hit the fan this would have gained more traction and they would have shook hands on a sweetheart deal like they always do. Klopp being front and centre on day 1 was a killer for the idea, Tuchel, Arteta, Mason and Solksjaer would have played dumb and batted away the questions, only Pep had the balls and authority to speak out if that's how he felt.

This is my understanding too which is why the "fine" has been described as a goodwill gesture and the Dirty 6 were able to insist it was to be spent on grassroots causes rather than be pocketed by the Angelic 14. Preventing someone leaving your association and setting up their own is clearly monopolistic and anti-competitive.

But I agree it was always a power grab. And in all honesty UEFA don't give 2 fucks about the pyramid either, just their ability to hold on to power and by extension, maintain the wealth they individually drain out of the game. There's no moral high ground to be taken by the PL 14, UEFA or the ESL 12. They're all just self interested money grabbing cunts.

Well as soon as City won that FFP fight on such a basic UEFA failure, anyone with pockets deep enough, or lawyers willing enough to work for the prestige, will always fancy their chances. Personally I think it is time for UEFA (and FIFA) to break into 2 parts. I think there should be a global body of law makers, who's job it is to manage the laws of the game. Then there should be a separate entity that run the competitions. The clubs should not control this entity like they do with the PL - although equally they should get a voice (and perhaps some form of veto). But the current system is just fucked.

Wonder what Brady did to get Boris and the London council to sign that deal. It should be investigated as the costs are showing that West Ham are saving tens of millions each year with a dodgy tory deal to back dodgy tory owners.
