Re libel in the US and UK.

 

In the UK we start from the perspective that there is no free speech. So if you can a statement about someone  (or repeat it) which would the standing of the subject in the minds of reasonable people then we have defamation (it is libel if in permanent form and slander if transitory and then different types of damage are recognised). It is then for the person who made the statement to prove that it is true (justification). So the law on defamation always favours those defamed rather than free speech.

 

In the States the work on the basis of free speech. So it is for the person defamed to prove the statement was made, not only that it did harm but it was made maliciously ie they knew it was false, they made the statement knowing it was false and did it with the deliberately intention of causing specific harm. It is very easy to dismiss a libel case in the US hence Elon Musk getting away with the pedo remarks to that diver
